All participants and/or parents or guardians of participants must read before signing: In consideration of the services of Main Street Skowhegan, their agents, owners, offers, volunteers, participants, employees, and all other persons or entities in any capacity on their behalf (hereinafter collectively referred to as MSS), I hereby agree to release, indemnify and discharge MSS on behalf of myself, my children, my parents, my heirs, assignees, personal representatives and estate, as follows:
1. I acknowledge that the bicycling, use of watercraft, and other outdoor recreation activities mentioned and not mentioned herein, offered by Main Street Skowhegan and the Skowhegan AmeriCorps Outdoor Recreation program entail known and unanticipated risks which could result in physical or emotional injury, paralysis, death or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.
2. I expressly agree and promise to accept and assume all of the risks existing in any of these activities. My participation in any of these activities is purely voluntary and I elect to participate in spite of the risks.
3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless MSS from any and all claims, demands, or causes of action, which are in any way connected with my participation in any of these activities, or my use of MSS equipment or facilities, including any such claims which allege negligent acts or omissions of MSS.
4. Should MSS or anyone acting on their behalf be required to incur attorney’s fees and costs to enforce this agreement. I agree to indemnify and hold them harmless for all such fees and costs. 5. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of injury or damage myself. I further certify that I have no medical or physical conditions which could interfere with my safety in this activity, or else I am willing to assume – and bear the costs of – all risks that may be created, directly or indirectly, by such condition.
6. In the event that I file a lawsuit against MSS, I agree to do so solely in the state of Maine and I further agree that the substantive law of that state shall apply in that action without regard to conflict of law rules of the state. I agree that if any portion of this agreement is void or enforceable, the remaining portions shall remain in full force and effect.
By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against MSS on the basis of any claim from which I have released herein. I also acknowledge responsibility and will bear all costs for damaged, stolen, or lost equipment. For use of any bicycling equipment I was offered a helmet free of charge and fully understand the risk of not wearing said “helmet” and for any use of watercraft equipment I was offered a free Personal Flotation Device (PFD) and fully understand the risk of not wearing said “PFD”.
I acknowledge that sledding with or without a helmet entails known and unanticipated risk. Which could result in physical, or emotional injury, paralysis, death or damage to myself, to property or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. I expressly agree and promise to accept and assume all the risks existing in this activity. My participation, and that of my minor children, in this activity is purely voluntary and I elect to participate in spite of the risks.
I also understand that ANYONE UNDER THE AGE OF 16 YEARS OF AGE is required by Maine State Law to wear a helmet when operating a bicycle. Additionally, I understand the laws regarding use of applicable vessel watercraft in the state of Maine, which are as follows: CHILDREN LESS THAN 12 YEARS OF AGE; are required to wear an appropriate lifejacket at all times. This can be a Type 1, Type 2 or Type 3. FOR THOSE 12 YEARS OR OVER; are required to wear a lifejacket on enclosed waters more than 100m from shore. This can be a Type 1, Type 2 or Type 3.

Finally, I understand that photos may be taken of me or those in my care under 18 for promotional purposes. My signature below indicates that I am okay with photos being taken with me or individuals who are under 18 in my care for promotional purposes. I will let a Skowhegan Outdoors facilitator know if I would not like photos taken of me.
I AM SIGNING THIS FORM ON BEHALF OF ALL OF MY DEPENDENTS UNDER THE AGE OF 18 THAT I'M BRINGING WITH ME TO THIS PROGRAM.
